These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and GoBig MarketPlace Technologies ("GoBig MarketPlace," "we," "our," or "us"), governing your access to and use of the platform and all related services at gobigmarketplace.ng (collectively, the "Services").

By creating an account, making a purchase, or otherwise accessing our Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our Services.

GoBig MarketPlace is a digital services platform offering four core service types:

To access most Services, you must create an account by providing accurate and complete information. You agree to keep your registration information current and accurate at all times.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must:

• Use a strong, unique password for your account
• Never share your credentials with any third party
• Notify us immediately at cashmenus@gmail.com if you suspect unauthorized access

You may not create multiple accounts. We reserve the right to terminate duplicate accounts without prior notice. Accounts found to be used for fraud, abuse, or violations of these Terms may be suspended or terminated at any time.

You may fund your GoBig MarketPlace wallet using Paystack or Flutterwave. All transactions are processed in Nigerian Naira (NGN) or the currency displayed at checkout. Wallet balances are non-transferable between accounts.

Due to the nature of digital services and immediate order fulfillment, the following applies:

SMM services are marketing tools designed to provide social proof and algorithmic signals. Important limits apply:

You acknowledge that purchasing SMM services may violate the terms of service of the social media platforms involved (Instagram, TikTok, YouTube, X/Twitter, etc.). You assume full responsibility for any consequences, including account suspension or banning by those platforms. GoBig MarketPlace is not liable for such outcomes.

• Manipulating election results or political discourse
• Promoting illegal content, hate speech, or harmful material
• Harassing or harming any individual or organization
• Fraudulently misrepresenting engagement metrics to investors, advertisers, or other parties

• Temporary numbers: SMS verification numbers expire within the time period specified at purchase. We do not guarantee that any specific third-party platform will accept our numbers for verification.
• Single-use: Unless otherwise stated, virtual numbers are for single-use verification purposes. You may not use them to register multiple accounts on a single platform where that violates the platform's terms.
• Shared infrastructure: Virtual numbers are not assigned exclusively to you and may be reused after your session expires. Do not use these numbers for sensitive personal communications.
• Legal use only: You may not use SMS verification services to commit fraud, impersonate others, or bypass security measures for unauthorized access to accounts you do not own.

• Device compatibility: eSIM plans require a compatible, unlocked device. You are responsible for confirming compatibility before purchase. We are not liable for eSIM plans that cannot be activated due to device incompatibility.
• Coverage: eSIM data coverage and speeds depend on local network availability in the destination country or region. We do not guarantee specific data speeds or network uptime.
• Activation is final: eSIM plans are activated upon delivery of activation credentials. Once activated, the plan is non-refundable regardless of usage or data consumed.

Account logs are pre-created digital accounts or credentials. You purchase these for lawful purposes only. We make no guarantee as to the availability, age, or ongoing functionality of any specific account log after delivery.

The following are strictly prohibited. Violations may result in account suspension, forfeiture of wallet balance, and legal action:

All content on the GoBig MarketPlace platform — including text, graphics, logos, interface design, code, and trademarks — is the exclusive property of GoBig MarketPlace Technologies or its licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our platform solely for your personal or business use in accordance with these Terms. You may not reproduce, distribute, modify, or create derivative works of any platform content without our prior written consent.

Our Services are provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties including:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that our Services will be uninterrupted, error-free, or secure
• Warranties that third-party social media platforms will accept or retain delivered SMM engagement
• Warranties regarding the results that may be obtained from using our Services

Your use of our Services is at your sole risk.

To the maximum extent permitted by applicable law, GoBig MarketPlace Technologies and its directors, employees, and agents shall not be liable for:

• Any indirect, incidental, consequential, special, or punitive damages
• Loss of profits, revenue, data, goodwill, or business opportunities
• Damages arising from third-party platform actions, including social media platform enforcement
• Service interruptions, provider delays, or force majeure events

You agree to indemnify, defend, and hold harmless GoBig MarketPlace Technologies, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

• Your use of our Services in violation of these Terms
• Your violation of any applicable law or third-party rights
• Any content you submit to or through our platform
• Your use of account logs, SMS numbers, or SMM services in an unlawful manner

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to conflict of law provisions.

Before initiating formal proceedings, you agree to contact us at cashmenus@gmail.com and attempt to resolve the dispute informally for at least 30 days.

If informal resolution fails, disputes shall be resolved by binding arbitration in Lagos, Nigeria, under the Arbitration and Conciliation Act (Cap A18) of Nigeria. Both parties waive the right to a jury trial and to participate in class action proceedings. Either party may seek injunctive relief in a court of competent jurisdiction without first exhausting arbitration.

You may close your account at any time by contacting cashmenus@gmail.com. Closing your account does not entitle you to a refund of any unused wallet balance unless required by applicable law.

We reserve the right to suspend or terminate your account at any time, with or without notice, if you violate these Terms, if we are required to do so by law, or if continued service creates legal, security, or reputational risk.

Upon termination, your right to access our Services ceases immediately. Sections 10 through 14 of these Terms survive termination.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or a prominent platform notice at least 14 days before the changes take effect. Your continued use of our Services after the effective date constitutes acceptance of the updated Terms. If you do not agree with updated Terms, you must stop using our Services before the effective date.
